Frequently Asked Questions
-
Q:What should I do after I am arrested?
A: First, exercise your right to remain silent. Don't try to explain anything to the arresting officer, just politely request a lawyer - this is your right. You should invoke your rights as soon as possible. Wait for your attorney to arrive and consult with him or her before answering any questions from the police.
-
Q:What is the difference between a misdemeanor and a felony?
A: Felonies are crimes that are punishable by more than a year in prison while misdemeanors are punishable by less than a year in prison. Typically, more serious offenses that involve serious injuries or deadly weapons are charged as felonies.
-
Q:Will I lose my driver's license after a DUI conviction?
A: Depending on the circumstances, you may lose your driving privileges temporarily. The court can revoke or suspend your driver's license for a certain period of time. If you want to contest the suspension and restore your driving privileges, then you must request a hearing with the DMV. If you refused to take a breathalyzer or other similar tests, then your driver's license may be suspended for an additional period of time.
-
Q:Will my case end up in trial?
A: This will depend on whether your attorney and the prosecutor can settle on a favorable deal before trial. Some charges can also be dismissed before a trial based on flimsy evidence or other reasons. Lawyers are more likely to take a case to trial only if he or she believes that you have a fair shot at winning. Talk to your attorney about the specifics of your case to weigh whether you should take a case to trial.
